Terms of Service — LectiFluentia

1. About the Service
LectiFluentia is a language learning web application, operated from Brazil, that allows registered users to upload texts in a foreign language, read them interactively, track vocabulary, and receive AI-generated word translations and reading assistance.
2. Eligibility
The Service is operated from Brazil. You must be at least 18 years old to create an account on your own. Minors aged 13 to 17 may use the Service only with the consent and under the supervision of a parent or legal guardian, who accepts these Terms on their behalf and is responsible for their use. The Service is not intended for children under 13, and we do not knowingly allow them to register. By using the Service you represent that you meet these requirements, and we reserve the right to terminate accounts that do not.
3. Accounts
3.1 Registration: Accounts are created through Clerk, our third-party authentication provider. You are responsible for maintaining the confidentiality of your credentials and for all activity that occurs under your account.
3.2 Accurate information: You agree to provide accurate and complete information when registering and to keep your account information up to date.
3.3 One account per person: You may not create multiple accounts to circumvent any restrictions or suspensions imposed on a prior account.
4. User-Uploaded Content
4.1 Your Responsibility for Uploaded Content: You are solely responsible for any text files, documents, or other content you upload to the Service. By uploading User Content, you represent and warrant that you have the legal right to upload, store, and process that content for personal language learning purposes — including the right to have the content transmitted to and processed by our third-party AI providers as described in Section 7 — that your use of the content does not violate any applicable law including copyright law, and that the content does not violate these Terms.
4.2 Privacy of Uploaded Content: Uploaded content is private to your account in that it is not shared with, or made visible to, other users and is not publicly accessible. To provide translation and reading-assistance features, however, your content is transmitted to third-party AI providers as described in Section 7 and in our Privacy Policy. We do not ourselves use your content to train AI models.
4.3 Licence to Operate the Service: By uploading User Content, you grant LectiFluentia a limited, non-exclusive, worldwide, royalty-free licence to store, process, and display that content solely for the purpose of providing the Service to you. This licence terminates when you delete the content or close your account.
4.4 We Do Not Read or Monitor Your Content: We do not read, monitor, or review the content of your uploaded texts, and we have no practical ability to determine whether any uploaded content is copyrighted, licensed, or otherwise lawful. Your uploads are accessed only by automated systems, and only to the extent necessary to provide the Service — storing them, displaying them back to you, and transmitting them to AI providers as described in Section 7. Responsibility for the legality of uploaded content rests entirely with you (Section 4.1). We have no obligation to monitor User Content, but we reserve the right to remove content that comes to our attention as violating these Terms or applicable law, without prior notice.
5. Copyright, Content Removal, and Repeat Infringers
LectiFluentia is operated from Brazil and acts as a neutral intermediary that merely hosts content uploaded by its users for their own private use. Our handling of user content is governed by the Marco Civil da Internet (Lei nº 12.965/2014) and the Brazilian Copyright Act (Lei nº 9.610/1998). Because we do not read or monitor user uploads (Section 4.4) and cannot assess whether content is copyrighted, we rely on rights holders to bring alleged infringement to our attention.
5.1 Reporting infringement: If you believe content stored on the Service infringes your copyright, send a notice to contact@lectifluentia.com identifying the copyrighted work, identifying the specific content and the account or location at issue (to the extent known to you), providing your contact details, and including a good-faith statement that the use is unauthorised. We will assess credible notices, comply with removal obligations imposed by a competent court order, and may also disable or remove the content at our discretion on receiving a credible notice.
5.2 Repeat infringers: It is our policy to suspend or terminate, in appropriate circumstances, the accounts of users who are repeat infringers.
5.3 Users in other jurisdictions: For claims directed at users in jurisdictions with their own notice-and-takedown regimes — such as the United States Digital Millennium Copyright Act (DMCA), 17 U.S.C. § 512 — we will also accept and act on notices that meet those requirements.
6. Acceptable Use
You agree not to use the Service to upload, store, or transmit unlawful, harmful, abusive, harassing, defamatory, obscene, or otherwise objectionable content; upload content that infringes intellectual property rights of others; attempt to gain unauthorised access to any part of the Service; reverse engineer, decompile, or disassemble any part of the Service; transmit malware, viruses, or any code of a destructive nature; use the Service for any commercial purpose without our prior written consent; circumvent any security measures, rate limits, or access controls; or use automated tools to access the Service in a manner that imposes an unreasonable load on our infrastructure.
7. AI Processing and Translations
7.1 How the feature works. The Service uses third-party AI providers to generate word translations and full-text reading assistance (such as Read Along and interlinear breakdowns). To do this, we transmit your content to those providers: for word translation, the word and a short context snippet; for reading assistance, the entire text you are working with. All content you upload may be transmitted in this way, regardless of whether it is otherwise private to your account.
7.2 Your authorisation. By uploading content and using these features, you authorise and instruct us to transmit the relevant words and full texts — including any content you upload — to the AI provider or providers we use, as necessary to provide the Service, and you authorise us to select and change those providers at our discretion (see 7.3). This transmission is essential and non-optional: the translation and reading-assistance features cannot be provided without it. If you do not wish your content to be sent to our providers, do not upload it or use these features.
7.3 Providers and loss of control. We use one or more third-party AI providers of our choosing and may add, remove, or change them at any time at our sole discretion; they currently include Anthropic (United States), OpenAI (United States), Replicate (United States), and DeepSeek (People's Republic of China). Once your content has been transmitted to a provider, its handling is governed by that provider's own terms and privacy policy and is outside our control; we cannot recall it. Provider practices differ: Anthropic and OpenAI state they do not train on API inputs or outputs by default; Replicate processes inputs and outputs to run model predictions and may use service-related data to improve its platform; DeepSeek stores data in the People's Republic of China and its terms currently permit use of submitted data for model improvement and other purposes, and such data may be subject to access under local law. By using these features you accept these conditions regardless of which provider we use for a given request. We will be transparent about which providers we use and will take reasonable precautions on our side, but we make no representation about, and accept no responsibility for, a provider's downstream use of content once transmitted.
7.4 No warranty of accuracy. AI-generated translations and breakdowns are provided for educational and informational purposes only, may be cached and shared across users for the same word and language pair, and may not be accurate, complete, or appropriate for all contexts. We make no warranty as to their accuracy. Do not rely on them for legal, medical, professional, or safety-critical purposes.
8. Intellectual Property
8.1 Our IP: The Service, including its code, design, visual identity, and documentation, is owned by LectiFluentia and its licensors. Nothing in these Terms grants you any right to our intellectual property except the limited right to use the Service as described.
8.2 Your IP: You retain all ownership rights in the User Content you upload. We claim no ownership over your uploaded texts, word ratings, or other personal data.
9. Termination
9.1 By you: You may delete your account at any time through the account settings. Deletion removes your personal data in accordance with our Privacy Policy.
9.2 By us: We reserve the right to suspend or terminate your account, without notice, if you violate these Terms, engage in conduct that harms other users or the Service, or for any other reason at our sole discretion.
9.3 Effect of termination: Upon termination, your right to use the Service ceases immediately. Content associated with your account will be deleted in accordance with our data retention schedule.
10. Disclaimer of Warranties
THE SERVICE IS PROVIDED 'AS IS' AND 'AS AVAILABLE' WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, OR UNINTERRUPTED OR ERROR-FREE OPERATION.
We do not warrant that the Service will meet your specific requirements, will be available at any particular time or location, that any errors or defects will be corrected, or that the Service is free of viruses or other harmful components.
11. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, LECTIFLUENTIA AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF OR INABILITY TO USE THE SERVICE, ANY USER CONTENT, ANY CONDUCT OR CONTENT OF A THIRD PARTY ON THE SERVICE, OR ANY COPYRIGHT INFRINGEMENT CLAIM RELATED TO USER-UPLOADED CONTENT.
12. Indemnification
You agree to indemnify, defend, and hold harmless LectiFluentia and its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses arising out of or relating to your use of the Service, your User Content, your violation of these Terms, or your violation of any applicable law or regulation.
13. Governing Law and Dispute Resolution
These Terms are governed by the laws of the Federative Republic of Brazil, without regard to conflict-of-laws rules. Any dispute arising out of or relating to these Terms or the Service shall be submitted to the courts of Brazil. Where you qualify as a consumer under the Brazilian Consumer Protection Code (Código de Defesa do Consumidor, Lei nº 8.078/1990), the competent court of your domicile applies, and nothing in these Terms removes any mandatory consumer protection afforded to you by Brazilian law.
14. Changes to These Terms
We may update these Terms from time to time. We will notify you of material changes by revising the date shown above. Your continued use of the Service after any changes constitutes your acceptance of the new Terms.
15. Severability
If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary so that the remaining Terms shall remain in full force and effect.
